Privacy Statement
This Privacy Statement applies to all personal data that Hopper&Fuchs collects from customers who use our services, both on our website and at a physical point of sale operated by Hopper&Fuchs. The relevant services are listed below under “Processing Purposes”. This Privacy Statement has been prepared and is kept up to date in accordance with the provisions and requirements of the European Privacy Regulation 2016/679 , the “General Data Protection Regulation” or “GDPR”.

- Hopper&Fuchs processes the personal data of its customers in a lawful, fair and transparent manner;
- Hopper&Fuchs processes the personal data of its customers only for specific and legitimate purposes;
- Hopper&Fuchs only processes the personal data of its customers that are necessary to achieve these purposes. Hopper&Fuchs will therefore not collect nor use any unnecessary personal data of its customers;
- Hopper&Fuchs only processes correct and current personal data of its customers. If the data turns out to be incorrect, you can have it adjusted. You can read more about how you can do this under “What rights do you have and how can you exercise them?”;
- Hopper&Fuchs will not keep the personal data of its customers for longer than necessary to achieve its purposes. As soon as the purposes are achieved, we will delete the personal data;
- Hopper&Fuchs will take appropriate measures to ensure that its customers personal data is properly secured and protected against loss, destruction and damage.
Hopper&Fuchs BV, Stokerijstraat 25 C8, 2110 Wijnegem, Belgium, is responsible for the processing of your personal data. Hopper&Fuchs has also appointed a person, a Data Protection Officer or DPO, who monitors the correct processing of your personal data. How to get in touch with Hopper&Fuchs or its DPO can be found below under “What rights do you have and how can you exercise them?”.
In order for Hopper&Fuchs to offer and perform its services, it needs various personal data from you. You can read below for which services and purposes Hopper&Fuchs needs this personal data. For this we mainly use personal data that we obtain directly from you, but also data that we collect ourselves, such as data about your visit to our website that is collected on the basis of cookies. 3.1. Process and deliver your orders (both on the website and the physical points of sale operated by Hopper&Fuchs).
In order to complete your order Hopper&Fuchs needs the following personal data from you: name and first name, e-mail address, delivery and invoicing address(es), payment details and sometimes your telephone or mobile number. This way we can finalize the payment of your order, deliver your order to the correct address and keep you informed of the status of your order. Some of this data is also shared with others. Hopper&Fuchs operates with external logistics and delivery partners. Hopper&Fuchs carefully selects its partners in such a way that they handle your personal data as dutifully as Hopper&Fuchs does itself. The processing of this personal data for this purpose is justified by the existence of the order (“agreement”) that you have placed.
3.2. Manage your online account on our website
You can create an online account on our website Hopper&Fuchs.com where we store a number of information about you. Hopper&Fuchs saves this information in your online account so that you do not have to enter it every time. This concerns the following data: name and first name, telephone or mobile number, e-mail address, delivery and invoicing address(es), payment details, an overview of all your orders, your wish list. You are not obliged to fill in all this information.
The retention of this personal data for this purpose is justified by the existence of a legitimate interest for Hopper&Fuchs. We want to be able to offer you a smooth and optimal service and by saving some of your data for you, you can save time. Creating an online account is completely non-binding and you can cancel your online account at any time. You can read how you can do this under “What rights do you have and how can you exercise them?”.
You can also change your communication preferences and permissions at any time.
3.3. Create and manage a wish list
On the Hopper&Fuchs website you can create a wish list containing the Hopper&Fuchs products you are interested in. You can create a wish list without creating an online account. This wish list remains based on cookies stored during the session and any subsequent sessions. You can read more information about Hopper&Fuchs' policy on cookies in our Cookie Statement.
However, you can also create an online account to create a wish list. In that case, we still need a number of information from you: name, first name and e-mail address. This way we can link your wish list to your personal data and keep the list longer for you. Hopper&Fuchs therefore has a legitimate interest in processing this data.
3.4. Send marketing communications and promotions (newsletters, SMS, social media, online advertising and other marketing campaigns)
You can always subscribe to one of our newsletters. This way you stay informed of our actions and promotions, benefits, research, events and you can receive customized product information. For this we ask for your e-mail address. We also communicate certain promotions via SMS if you have provided your mobile number for this, or we will send them to your home. We compile customized product information based on your data, such as your favorite author and previous purchases and orders, and also on the basis of cookies that our website uses. In this way we can better tailor the information to your interests. You can read more information about our cookie policy in our Cookie Statement. We send these newsletters, customized information, research, and other marketing campaigns if you have given your consent. You will also receive certain information if you are already a customer with us and we want to inform you about products similar to the ones you have purchased from us in the past.
In addition, we communicate some of our marketing campaigns through our own website, third party websites and various social media platforms such as Facebook and Instagram. We can create target groups based on our e-mail addresses or of visitors to our website and approach them with personalized advertisements through these channels.
Do you have an online account at Hopper&Fuchs? Then you can find an overview of all communications you receive in your online account under your communication preferences and you can easily adjust these online. You will also find an unsubscribe link at the bottom of every email. In this way you can always withdraw your consent to receive e-mails. If you unsubscribe from communication through specific channels, you will no longer receive the newsletter, SMS or other information or you will no longer encounter personalized advertisements or messages on social media platforms or other websites. Keep in mind that a certain processing time is needed to process your request and that in the meantime there is a chance that you will still receive the communication. This processing time is kept to a minimum. Also keep in mind that you can still see digital advertisements and banners from Hopper&Fuchs on social media, for example. However, these are general advertisements that are not tailored to the interests that you have communicated to Hopper&Fuchs. If you no longer wish to receive it, you must adjust this in your settings on the relevant platform. 3.5. Improving our services
Hopper&Fuchs wants to constantly improve its services online and in the store. For this we would like to hear your opinion. By means of (satisfaction) surveys that we send to your e-mail address, we can see where our services can be improved. Hopper&Fuchs has a legitimate interest in sending these surveys. However, if you no longer wish to receive these questionnaires in the future, you can unsubscribe at any time via the unsubscribe link at the bottom of each survey. The data is also shared with others. Hopper&Fuchs uses external mailing tools to process the surveys. The data may only be used by the external service provider in the context of processing the surveys and not for the external service provider's own purposes.
3.6. Handling customer inquiries or complaints
For all your questions and comments or complaints you can contact our customer service or you can visit one of our stores. You can fill in a special contact form that you can find on our Frequently Asked Questions page. This form is then sent to our customer service. Or you can just call or email customer service. Complaints can also come in via social media platforms such as the Hopper&Fuchs Facebook page. The following data can be collected: name and first name, address, e-mail address, telephone or mobile number, gender, order reference and information about the complaint in our systems. Hopper&Fuchs only uses this information to be able to respond as well as possible to your question or complaint. Phone conversations you make with someone from our customer service are not recorded and saved. The use of this personal data for this purpose is justified by the existence of a legitimate interest for Hopper&Fuchs.
Hopper&Fuchs keeps your personal data in a secure manner and we do not keep this data longer than necessary to realize the purposes stated above or to comply with our legal or contractual obligations. If you wish that Hopper&Fuchs no longer keeps track of your personal data or if you would like more information about the retention periods we use, you can contact our customer service. Who do we share your personal data with?
In order to guarantee you the best service, we may work together with third parties specialized in certain domains. Hopper&Fuchs carefully selects these partners to make sure they handle your personal data to our standards. With any of these parties we only share the personal data necessary to fulfill their operations. Hopper&Fuchs therefore does not sell your personal data to third parties and these parties may not use the data for their own (commercial or non-commercial) purposes. Hopper&Fuchs has also concluded a processing agreement with each of these parties (called processors), in which the above is contractually stipulated.
We work with processors for the following activities:
Management, hosting and maintenance of the website and website activities (including order processing, wish list, online account management);
Processing of your payment in our webshop;
Customer database management;
Delivery of orders;
Marketing activities (online and on paper);
Processing your questions and complaints through our customer service;
Marketing research;
Activities on social media (competitions, direct marketing).
Hopper&Fuchs may use your personal data to do profiling. Profiling is the collection, analysis and combination of (personal) data with the putting customers into a specific marketing segment or profile. This allows certain behavior to be predicted. We do this to support our marketing strategy and tailor our marketing communications.
Hopper&Fuchs uses data on an aggregated level to make analyzes and sub-categorize customers. The purpose of this is to analyse on a global and aggregated level that allows Hopper&Fuchs to make better choices and to improve its services (eg offering a better range). Profiling is also used at your individual level so that you receive more personalized information.
Profiling may also be used on our website to offer the customer a better surfing experience by providing a more personalized offer when using our website. For this we may use tracking cookies and other digital marketing tools and we use online advertising. However, you can always disable tracking cookies in your browser. More information about this can be found in our Cookie Policy. These customer profiles are also used on an aggregated level to improve our services.
Hopper&Fuchs uses Google Analytics. This data is only used on an aggregated level and is not traced back to customers on an individual basis.
You have the right to object to automated decision-making, including profiling. You can read about how to exercise this right under “What rights do you have and how can you exercise them?”. Hopper&Fuchs uses personal data of customers for specific purposes and only collects the personal data it really needs to achieve those purposes. We want to be as transparent and clear as possible about the activities for which we collect, use and secure your personal data. As a result, Hopper&Fuchs has developed a policy so that you can exercise your rights with regard to the personal data that you have entrusted to us. In accordance with the applicable privacy legislation, you have various rights.
7.1. Right to view your data
You have the right to ask Hopper&Fuchs at any time what categories of data we hold about you and what we use it for and you can request a copy of this. You can also ask how long we keep your data, on what legal basis (consent, agreement, legal obligation, legitimate interest, public interest, vital interest) we process your data, etc. By exercising this right you can also check whether the information we have about you is correct. You can exercise this right by filling in the special contact form that is provided to our customer service with your request for access. If you have created an online account with us, you can always find an extensive overview of the data we have about you there.
7.2. Right to have your data corrected
If you notice that the personal data we have about you is incorrect or incomplete, you can have it corrected or supplemented. Just like with the right of access, you can fill in the special contact form. If you have an online account, you can also correct or supplement certain personal data yourself. Or you can contact customer service by calling or emailing.
7.3. Right to have your data erased
You have the right to request that Hopper&Fuchs delete the personal data it holds on you. Please note that this right is not absolute. One of the following conditions must apply:
- Hopper&Fuchs no longer needs your personal data to realize its purposes;
- You have withdrawn your consent for a certain activity and Hopper&Fuchs has no other legal ground (agreement, legal obligation, legitimate interest, public interest, vital interest) that justifies maintaining your personal data;
- You have objected to a certain processing (see right 5) and Hopper&Fuchs has no overriding legitimate interest in the processing;
- Hopper&Fuchs has unlawfully processed your personal data (e.g. if there is no legal basis for the processing: consent, agreement, legal obligation, legitimate interest, public interest, vital interest);
- Your personal data must be erased to comply with a legal obligation;
Our customer service, in consultation with our DPO, will decide whether one of the conditions is met. If it is judged that one of these conditions apply, your personal data will be erased. If your data has been passed on to our processors for certain purposes, Hopper&Fuchs will inform all these processors that they must also erase your data. Please note erasing your personal data is an irreversible process. If you subsequently wish to make use of our services again, you will have to provide your personal data again.
You can exercise your right by filling in the special contact form that is sent to our customer service.
7.4. Right to request the limited processing of your data
By requesting the limited processing of your personal data, it remains possible for Hopper&Fuchs to keep track of the data, but the use of the data is limited. The exercise of this right is possible when 1 of the following 4 cases applies:
- You dispute the correctness of your data. In this case, the processing of your data will be limited for the period that Hopper&Fuchs needs to check the correctness of the data;
- The processing of your data is unlawful, but you do not want the data to be erased. Instead, you can request that the use of your data be restricted;
- Hopper&Fuchs no longer needs the personal data to realize its purposes, but you still need the data to be able to establish, exercise or defend your rights in court;
- You have objected to the processing of your data (see right 5). Pending the answer to the question whether the legitimate interests of Hopper&Fuchs outweigh your rights, the processing of your data may be restricted.
If one of these cases applies Hopper&Fuchs can only keep your data but not use it more. If Hopper&Fuchs still wants to do other things with your data, this will only be possible in limited cases (including by again requesting your permission for the processing of your data). You can exercise your right by filling in the special contact form that is sent to our customer service.
7.5. Right to object to the processing of your data
You have the right to object to the processing of your data if this processing is based on a public interest or the legitimate interest of Hopper&Fuchs. Under the chapter “What do we use your personal data for? (Our purposes)” you can find the activities for which Hopper&Fuchs has a legitimate interest. If you invoke this right, Hopper&Fuchs will investigate whether its legitimate interests for that processing outweigh your interests, rights and freedoms. If this is not the case, Hopper&Fuchs will no longer process your data for that purpose.
You can also object to the processing of your personal data for direct marketing purposes, including profiling related to direct marketing. If you invoke this right, Hopper&Fuchs will no longer process your data for marketing purposes. Under “Automated decision-making, including profiling” you can find more information about the way Hopper&Fuchs engages in automated decision-making, including profiling.
You can exercise your right by filling in the special contact form that is sent to our customer service.
7.6. Right to portability of your data
This right means that you will receive back the data you have provided to Hopper&Fuchs. This right only applies to the processing of data that is based on your permission (e.g. permission to send the newsletter) or on an agreement (e.g. buying a book online). An additional aspect of this right is that you can transfer the data that you receive back to another controller without Hopper&Fuchs opposing this. Please note, this only concerns the data that you have provided directly to Hopper&Fuchs. You can exercise your right by filling in the special contact form that is sent to our customer service.
7.7. Right to withdraw your consent
As before under “What do we use your personal data for? (Our purposes)” has been stated, you can revoke this permission at any time for all processing operations for which Hopper&Fuchs requests your permission. Please note, however, that withdrawing your consent has no impact on and does not affect the processing that Hopper&Fuchs did before your consent was withdrawn. You can withdraw your consent in several ways:
You can unsubscribe from newsletters, direct marketing campaigns, events, research and other customized information via the unsubscribe link that is always stated at the bottom of the sent newsletters;
You can fill in the special contact form that is sent to our customer service, asking you to withdraw your consent for a certain activity;
You can also change your communication preferences and withdraw your consent at any time via your online account.
Keep in mind that a certain processing time is needed to process your request and that in the meantime there is a chance that you will still receive the communication. This processing time is kept to a minimum.
Also keep in mind that you can still see digital advertisements and banners from Hopper&Fuchs on social media, for example. However, these are general advertisements that are not tailored to the interests that you have communicated to Hopper&Fuchs. 7.8. How can you exercise your rights?
As indicated earlier in the declaration of your rights, you can exercise your rights by filling in the special contact form. In addition, you can always fill in a contact form in the store or contact customer service by email or telephone. You will also have to fill in a contact form for these alternatives. On the form we ask you to provide a number of information as well as what right you want to exercise or what question you have with regard to the processing of your personal data.
We request your personal data here so that we can uniquely identify you in our systems and certainly not share personal data with people who pretend to be someone else. We ask if you can scan and send the front of your identity card (the photo does not have to be visible). If you wish to exercise one of your rights in the shop, you can show the front of your identity card to the shop assistant. If you are not able to provide us with the front of your identity card by e-mail, we request that you submit your request in one of our stores so that your identity can be verified there. In addition, we will ask you for the following information: your place of residence, e-mail address, telephone or mobile number, your customer card number and a description of your question. All requests are directed to customer service. Once they have received your request, they will send you a confirmation email that your request is being processed. You will receive a final answer within one month of receiving your question. If you do not have an email address, the confirmation email will be sent to the store where you made the request and the final answer will be sent by post.
Finally, we would like to emphasize once again that you can find extensive access to your data on your online account (if applicable) where you can also supplement or improve this data.
If, despite our answer, you still have certain questions or dissatisfaction, you can always contact the supervisory authority. For Belgium this is the Data Protection Authority (abbreviated “DPA”).
Security of your personal data
We recognize our responsibility to provide an appropriate level of security for the information you entrust to us. Hopper&Fuchs has therefore taken various measures to protect personal data against loss, misuse and unauthorized access, disclosure, alteration or destruction. At the organizational level, measures related to limited access to and monitoring of the buildings, systems and files are implemented, among other things; But technical measures including firewalls and encryption, protection through personal passwords and authentication, as well as authentication requirements for access to personal data on a need-to-know basis are also provided.
We also expect our processors to be able to guarantee an appropriate level of security when they process personal data for Hopper&Fuchs. We have also contractually agreed this with all our processors.
